  • Transplantation of Human Organs and Tissues Act (THOTA),1994, and the rules regulate organ and tissue donation and transplantation in India.

  • For the kind attention of Foreign citizens who seek organ transplant treatment in India:

  1. A Medical Visa is required for both the donor and the recipient to treat diseases that require organ transplantation.

  2. Authorisation Committee Approval is mandatory before harvesting the organ if either of the donor or the recipient is a foreign national.

  • Criteria of donation from the following: 

  1. Living donor: The donor should be more than 18 years of age and a close relative (e.g., spouse, parent, child, or grandchild) to the recipient. The relationship should be certified by a senior official from the embassy of the donor's country of origin in India.

  2. Deceased donor: Foreign nationals can register and wait but will stand a chance for organ allocation once no Indian patient can take that organ.

  • Commercial dealing of human tissues/organs in India is a punishable and prohibited offense.
